Terms of Service

You must be at least 13 years old to use Yokul.

If the minimum legal age to use services such as Yokul in your country, state, province, or jurisdiction is higher than 13, you must meet that higher minimum age.

By creating an account, you represent that you meet the applicable minimum age and are legally permitted to use Yokul.

We may suspend or delete accounts belonging to users who do not meet applicable age requirements.

You are responsible for maintaining accurate account information and protecting your login credentials.

You are responsible for activity occurring through your account.

You may not:

• Impersonate another person
• Create an account using false information intended to deceive others
• Access another person’s account without authorization
• Sell, transfer, or improperly share an account
• Use Yokul after we have suspended or terminated you without our permission

Notify us at support@yokulapp.com if you believe your account has been compromised.

Yokul is fundamentally a location-based social network.

Features may use your device’s location to determine nearby content, create or contribute to Spots, display Town Square content, calculate distances, show maps, and provide other location-based functionality.

Location information can be inaccurate.

You should never rely on Yokul for emergency services, navigation where errors could cause harm, or other safety-critical purposes.

You are responsible for your decisions regarding where and when you use Yokul.

Yokul allows users to create, upload, transmit, and share content, including:

• Photos
• Videos
• Text
• Comments
• Messages
• Spot Forum posts
• Town Square posts
• Profile information
• Other user-generated content

You retain ownership of content you create and own.

However, by submitting content to Yokul, you grant Yokul a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, transmit, display, distribute, and otherwise use that content as reasonably necessary to operate, provide, improve, promote, and maintain the Services.

This license allows Yokul to technically operate the service. It does not transfer ownership of your content to Yokul.

You represent that you have all rights and permissions necessary to submit the content you provide.

Yokul allows content to become associated with physical locations.

By posting content to a Spot or other location-based feature, you understand that:

• The content may be associated with that geographic location
• Other users may see the content
• Other users may infer that you visited or were associated with that location
• Information associated with a location may remain visible until removed in accordance with Yokul’s policies

Do not use location-based features in a manner that endangers yourself or another person.

Yokul may allow users to create or contribute to location-based areas known as “Spots.”

Certain users may receive designations such as “Founder” based on being the first Yokul user to create or contribute content that establishes a Spot.

A Founder designation is a feature of the Yokul service and does not:

• Grant ownership of the physical location
• Grant ownership of the business or property associated with the Spot
• Create intellectual property rights in the location
• Give the user authority to speak for a business or property owner
• Create any legal interest in real property
• Guarantee that the designation will remain available indefinitely

Yokul may modify, merge, relocate, rename, remove, or otherwise administer Spots when reasonably necessary to maintain the Services.

You may not use Yokul to:

• Threaten, stalk, harass, bully, or intimidate others
• Track another person for an unlawful or harmful purpose
• Exploit or endanger minors
• Post child sexual abuse or exploitation material
• Promote sexual exploitation
• Post unlawful pornography
• Make credible threats of violence
• Encourage violence against another person
• Promote terrorism or violent extremism
• Commit or facilitate fraud
• Impersonate others deceptively
• Distribute malware or malicious code
• Spam users
• Violate another person’s privacy
• Publish sensitive personal information about another person without authorization
• Infringe copyrights, trademarks, or other intellectual property rights
• Engage in illegal activity
• Interfere with Yokul’s operation or security
• Attempt unauthorized access to Yokul systems or accounts
• Scrape or automatically collect information from Yokul without written permission
• Circumvent security, moderation, or access controls

You may not use Yokul to determine, monitor, publish, or exploit another person’s location for stalking, harassment, intimidation, criminal activity, or another harmful purpose.

Never confront another person solely because of information appearing on Yokul.

Users are responsible for exercising appropriate caution when interacting with people they encounter through the Services.

Yokul may provide tools that allow users to report content, report users, and block other users.

We may investigate reported content or activity.

Yokul reserves the right, but does not assume an obligation to monitor every piece of content posted through the Services.

We may remove, restrict, disable, or limit access to content or accounts that we reasonably believe:

• Violate these Terms
• Violate applicable law
• Create safety or security risks
• Infringe the rights of others
• Are fraudulent, abusive, or harmful
• Could expose Yokul or its users to legal or security risks

Serious or repeated violations may result in permanent account termination.

Except for user-generated content, Yokul and its associated software, designs, logos, graphics, interfaces, trademarks, branding, and other proprietary materials are owned by Yokul LLC or its licensors.

These Terms do not grant you ownership of Yokul’s intellectual property.

You may not copy, modify, distribute, reverse engineer, sell, license, or commercially exploit Yokul or its proprietary technology except where expressly permitted by law or by Yokul in writing.

Yokul respects intellectual property rights.

If you believe content on Yokul infringes your copyright or other intellectual property rights, contact support@yokulapp.com.

Provide sufficient information for us to identify the content and evaluate your request.

Yokul uses third-party services, including technologies provided by Google Maps Platform, Sendbird, and Amazon Web Services.

Your use of certain features may therefore also be subject to applicable terms or policies of those providers.

Yokul is not responsible for independent third-party services outside our control.

You may delete your Yokul account using the account deletion functionality provided by Yokul.

Account deletion will result in deletion of the account and associated personal information and user-generated content, subject to information that Yokul is legally required or permitted to retain.

Deletion may not immediately remove information from technical backups.

We may suspend, restrict, or terminate access to Yokul if we reasonably believe you have:

• Violated these Terms
• Created a safety risk
• Violated applicable law
• Infringed another person’s rights
• Attempted to compromise Yokul’s systems
• Engaged in fraudulent or abusive behavior

You may stop using Yokul at any time.

We work to keep Yokul available and functioning, but we do not guarantee uninterrupted or error-free operation.

Features may change.

We may add, remove, modify, suspend, or discontinue features or portions of Yokul.

Location information, maps, distances, business information, user-generated information, and other information displayed through Yokul may contain errors or become outdated.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOKUL AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

YOKUL MAKES NO GUARANTEE THAT:

• THE SERVICES WILL ALWAYS BE AVAILABLE
• CONTENT WILL BE ACCURATE
• LOCATION INFORMATION WILL BE PRECISE
• USERS WILL BE WHO THEY CLAIM TO BE
• USER-GENERATED CONTENT WILL BE ACCURATE OR SAFE
• THE SERVICES WILL BE FREE FROM ERRORS OR SECURITY VULNERABILITIES

YOU USE YOKUL AT YOUR OWN RISK.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Yokul provides technology that allows users to discover content and interact with other users.

Yokul does not control users’ conduct outside the Services.

You are responsible for exercising appropriate judgment when communicating with, meeting, or interacting with another user.

Yokul is not responsible for personal meetings or interactions arranged through the Services except to the extent liability cannot legally be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOKUL LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES.

This includes, where permitted by law, losses resulting from:

• User-generated content
• User conduct
• Loss of data
• Unauthorized account access
• Location inaccuracies
• Service interruptions
• Interactions between users

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Yokul LLC and its members, officers, employees, contractors, and affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from:

• Your violation of these Terms
• Your content
• Your misuse of the Services
• Your violation of another person’s rights
• Your violation of applicable law

To the extent permitted by applicable law, these Terms and disputes arising from them will be governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

Nothing in this provision eliminates consumer rights that cannot legally be waived under the laws applicable where you live.

We may update these Terms as Yokul evolves.

If we make material changes, we may provide notice through the Services or by another reasonable method.

Your continued use of Yokul after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

These Terms, together with the Yokul Privacy Policy and any additional terms or policies expressly incorporated into them, constitute the agreement between you and Yokul concerning your use of the Services.

If any provision is found unenforceable, the remaining provisions will continue in effect.
